TERMS AND CONDITIONS FOR HOME ONE FESTIVE DHAMAKA
1. Program Details, Concept and Participation:
1.1. These terms and conditions apply to “Home One Festive Dhamaka” (hereinafter "Program") for voluntary participation of retailers, launched by Reliance Retail Limited (hereinafter “Reliance”), and conducted/administered by Premier Sales Promotions Pvt. Ltd. 4th Floor, Mitra Towers, 10/4, Kasturba Road, Bangalore - 560001 Karnataka (hereinafter “Agency”).
1.2. The Program is valid only in India from 10th September,2024 to 10th January ,2025 (both dates inclusive) (herein after referred as “Program Period”). Products without this offer are available. Any entry for the Program after 10th January ,2025 shall be considered invalid and will summarily be rejected. Participation in the Program is completely voluntary and the same shall be construed as an acceptance of the terms and conditions stipulated herein.
1.3. The Program is applicable only on selected products of ‘Home One’ (hereinafter the “Products”) and made available to selected retailers only.
1.4. The Program is subject to Product availability, all applicable central, state, and local laws and regulations.
1.5. Retailers participating or seeking to participate in the Program shall individually be referred to as “Participant” and collectively as “Participants”.
1.6. Regular call and message rates will apply as per the retailer’s telecom operator in their respective circle.
1.7. Reliance / its Agency reserves right to cancel / amend / extend the Program Period without giving any notice/intimation. No claims/questions shall be entertained in this regard.
1.8. Reliance / its Agency shall not be held liable for technical issues including but not limited to Participant’s UPI KYC being incomplete, bank account(s) not being active, login issues, relating to the redemption of the Code (defined below).
2. Agreement to Terms and Conditions:
2.1. By participating in this Program, Participants fully and unconditionally agree to and accept these Terms and Conditions as well as the decisions of Reliance, which are final and binding in all matters related to the Program. Successfully entering the Program and receiving a Reward (defined below) is subject to fulfilment of all terms and conditions mentioned herein.
2.2. Reliance reserves the right to exclude any person from the Program on grounds of misconduct or criminal record.
2.3. Reliance reserves the right to terminate, modify or extend the Program, at any time at its absolute discretion, without assigning any reason. All decisions of Reliance in respect of the Program and the Reward therein will be final and binding.
2.4. If this Program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Reliance and/or its Agency, including but not limited to technical difficulties, unauthorized intervention or fraud, Reliance / Agency reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any retailer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Program, as appropriate.
2.5. If for any reason this Program is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of Reliance or the Agency, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Program, Reliance reserves the right in its sole discretion to cancel, terminate, modify or suspend the Program.
2.6. Reliance and the Agency shall not be responsible for (including but not limited to): - 
- For any SPAM generated messages:
- For the Operator Code not being displayed on the user's mobile phones;
- For any SMS message delivery failures; 
- Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason;
- If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign; and/or
- Other conditions beyond its reasonable control
3. Eligibility:
3.1. This Program will be open to all the retailers who are residents of India, excluding the employees, their immediate family members, agents, distributors, retailers and any other channel partner of Reliance and the Agency. The Program shall be applicable to the retailers who are residents of Tamil Nadu subject to the provisions of clause 5.1, below.
3.2. The Participant shall be above the age of 18 (eighteen) years.
3.3. Reliance or the Agency will not be responsible for any NDNC (National Do Not Call) Registry regulation that will come into play. All Participants who participate will agree as per the terms and conditions that even if they are registered under NDNC, DND (Do Not Disturb), Reliance or the Agency will have all the authority to call such Participants by virtue of them having voluntarily participated in the Program.
4. How to Participate:
4.1. To be eligible for the offer, a Participant (“Participant”) must present valid invoices, in the manner provided in this clause 4, for purchase of Products of minimum amount of ₹ 25,000/- (Rupees Twenty-Five Thousand only) during the Program Period (“Invoices”).
4.2. Each eligible Participant will receive a voucher for all valid Invoices totalling up to ₹ 25000/- (Twenty-Five Thousand only) (“Voucher”). Multiple valid Invoices adding up to ₹ 25,000 (Rupees Twenty-Five Thousand only) shall also make the Participant to be eligible to receive a Voucher under this Program. 
For illustration: if a Participant presents valid Invoice/s of ₹ 50,000/- (Rupees Fifty Thousand only), they shall be eligible to receive 2 (two) Vouchers. A Participant who presents valid Invoice/s amounting to ₹ 48,000/- (Rupees Forty-Eight Thousand only) shall be eligible for 1 (one) Voucher only. 
4.3. An invoice once validated and used for claiming cashback under this offer cannot be used for claiming another cashback during the offer period.
4.4. Every Participant who receives the Voucher/s, under the Program, will scratch the scratch/silver panel to reveal the unique code (“Code”);
4.5. The retailer/Participant will scan the QR code on the Voucher that will redirect them to the microsite: www.homeonefestivedhamaka.com or will directly visit the said microsite; 
4.6. The Participants will enter the Code on the microsite along with their name, mobile number, state where the cashback is being claimed along with the pin code of the area from where the reward is being claimed. 
4.7. The Participants will enter the Invoice number/s and date/s that are eligible under the Program, per clause 4.1., and will upload the Invoices, if prompted to do so, on the microsite. 
4.8. The Participants will then receive an OTP (one time password) on their provided mobile number which they will enter on the microsite within 60 seconds of receipt of the OTP. 
4.9. The successful Participants will receive a notification of the cashback amount that they are eligible to receive (“Reward”) subject to the Invoices being validated by the Agency;
4.10. The eligible Participants will select their preferred payment mode (NEFT/UPI), partnered by Cashfree Payments India Pvt Ltd. (“Processing Partner”). The participant confirms that they have gone through Processing Partner’s Privacy Policy – https://www.cashfree.com/privacypolicy/ and that they have no objection in collection or processing of their data according to the manner carved out in the privacy policy.
4.11. The eligible Participants will be prompted to enter their Bank details or UPI id, basis their preferred mode of payment;
4.12. To proceed, the Participants will click on “Proceed Payment”;
4.13. Upon validation of Invoices and its correctness, the Participants will receive a confirmation of the payment process being initiated within 4 (four) business days from the date of completion of above steps;
4.14. The Reward will be credited to their Bank Accounts within 24 (twenty-four) to 48 (forty-eight) hours of confirmation received by the Participant of the payment process being initiated.
4.15. A Code is for one-time usage only. Any Code entered after 10th January ,2025, 11:59 p.m. shall be considered invalid and will summarily be rejected. 
4.16. A Voucher is non-transferable and cannot be used in conjunction with any other promotional offer/programs.
5. Reward:
5.1. For the Participants who are residents of Tamil Nadu: All the Participants in the state of Tamil Nadu shall be eligible to receive a flat cashback reward of ₹ 750 (Rupees Seven Hundred and Fifty) only through the process provided above in clause 4. 
5.2. For the Participants who are residents of the rest of India, except Tamil Nadu: All the Participants residing in any state of India will be eligible to receive a cashback amount between ₹ 750 (Rupees Seven Hundred and Fifty) to ₹ 9,999 (Rupees Nine Thousand Nine Hundred and Ninety-Nine) only, through the process provided above in clause 4. 
5.3. Process of Reward distribution shall be administered by the Agency. 
7. Publicity:
7.1. The Participant/s undertake and irrevocably and unconditionally permit Reliance to cover the Program through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.
7.2. The winners must, at the request of Reliance participate in all Program activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to Reliance using their name and image in Program material.
8. Intellectual Property:
8.1. All right, title and interest, including but not limited to the Intellectual Property Rights, in the Program material(s) and in all responses received shall always vest solely and exclusively with Reliance. Reliance or any person or entity permitted by Reliance in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future Program, marketing, publicity, and any other purpose, without any permission and or payment to the Participant.
8.2. All material submitted in connection with the Program (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Reliance upon submission and become the property of Reliance exclusively. Reliance may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of Reliance.
9. General Conditions:
9.1. Rights to use data - By participating in this Program:
a. The Participant expressly confirms and represents that he/she has read the Terms & Conditions of the Program on how to enter, and details on usage, collection, retention and sharing of personal data by the Agency;
b. It is clarified that Reliance shall not be collecting any data/personal data (“data”) of the Participants. All such data shall be collected by the Agency solely for the purpose of this Program (“Purpose”) and shall be processed by the Agency and the Payment Processing Partner (defined below) for the Purpose alone. 
c. The participant agrees to be bound by the terms, in particular those relating to the collection, retention, use and sharing of personal data as shared by the Agency and the Payment Processing Partner; and
d. The participant confirms that they have gone through Agency’s Privacy Policy – https://www.bigcity.in/privacy-policy/ and that they have no objection in collection or processing of their data according to the manner carved out in the privacy policy.
e. Reliance encourages participants to read the privacy notice of the Agency before sharing personal data. If the Participant does not want his / her personal data to be collected under this Program, the Participant can always choose not to participate in the Program.

9.2. Each Participant represents and warrants that he/she is legally competent to enter binding contracts under applicable laws. By taking part and/or entering the Program, the Participant warrants that all information provided by Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.
9.3. Reliance or its Agency reserves the right, at its sole discretion, to verify eligibility and disqualify users, and Rewards may be withdrawn for those who do not meet the Program requirements or in case of reasons including but not limited to any misuse of the offer or fraud, or suspicious transactions/activities. 
9.4. The Reward cannot be exchanged and is not transferable.
9.5. Reliance reserves the right to change, defer, alter, or cancel this Program in part or full, or change any or all the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of Reliance in this regard and in general with respect to this Program and the terms and conditions thereto shall be final, binding, and non-negotiable.
9.6. Nothing contained herein amounts to a commitment or representation by Reliance to conduct further Programs.
9.7. The decision of Reliance shall be final in all regards and no communication shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between any Participant and Reliance, and the Participant shall not have the authority to bind Reliance in any manner whatsoever.
9.8. Reliance or any of its respective officers/employees/directors shall not be responsible for delayed, lost, mutilated, corrupted or illegible documents etc.
9.9. Reliance or its Agency shall not be liable to perform any of its/their respective obligations under the Program or in respect of the prize where it is unable to do so because of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other Force Majeure condition, etc., and shall not be liable to compensate the Participant in these circumstances.
9.10. Reliance or its Agency shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Program due to any government restrictions.
9.11. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of Reliance or its Agency.
9.12. Reliance or its Agency accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of SMS, loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. Reliance or it’s Agency shall not be liable for any consequences of user error including (without limitation) costs incurred.
9.13. If a Participant is dissatisfied with the Program or the Program rules and/or any content or any requirements of the Program form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Program.
9.14. This Program is not applicable for any person outside India.
9.15. The operational and administrative part of the Program shall be managed by Agency.
9.16. To participate in this Program, standard fair usage policy and usage norms set by the respective telecom operator shall apply.
9.17. The Program is subject to the guidelines/directions issued by the Telecom Regulatory Authority of India, Department of Telecommunications, and any governmental or statutory authority as may be applicable from time to time.
9.18. Reliance or the Agency is not responsible for non-Delivery or receipt of an SMS by their servers or on the end user’s device due to retailer handset issues, network issues or due to any issues at cellular operator’s end. By participating in this program, the retailer understands that all such queries are to be directed to their current service provider directly and not hold Agency or Reliance responsible for the same.
10. Release and Limitations of Liability:
10.1. Reliance and its Agency shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, because of acceptance of any prize.
10.2. By entering the Program, the Participant hereby releases from and agrees to indemnify Reliance and/ or any of its respective officers/employees from and against all liability, cost, loss, or expense arising out of acceptance of the Reward or participation in the Program including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
10.3. Reliance and its Agency accept no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself, Agency or third parties in relation to the prizes.
10.4. The Participant shall be solely responsible for any consequences which may arise due to his/her participation in the Program by conducting an illegal act. Participant also undertakes to indemnify Reliance and/or its Agency and their respective officers, directors, employees and agents as a result of breach of terms of this Program or any other incidental event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by Reliance or its Agency on account of such act on the part of the Participant.
10.5. In consideration of Reliance allowing the Participant/s to take part in the Program, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against Reliance its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Program or related to the Program or the Reward under the Program.
11. Dispute:
11.1. The courts of competent jurisdiction at Mumbai shall have exclusive jurisdiction to determine all disputes arising out of, or in connection with, the Program. Participation in the Program is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including (without limitation) this clause.
11.2. Further all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or Reliance and/or its Agency of this Program, shall be governed and construed in accordance with the laws of the Republic of India.
